Commissioning of Documents and Affidavits

The Clerk’s office provides a Commissioner of Oaths to sign documents such as affidavits at their discretion.

A commissioner for taking affidavits (also known as a Commissioner of Oaths) is a person authorized by the Province of Ontario to administer oaths or declarations when you sign an affidavit or statutory declaration. A Commissioner of Oaths does not certify that the statements being made in the affidavit or statutory declaration are true, but only certifies that an oath or solemn affirmation has been administered properly.

About your appointment

The person(s) signing the affidavit must appear before the Commissioner of Oaths and must show government issued identification that contains a current photo, signature and current address, such as a valid driver's licence or Ontario Photo ID card. The documents must be completed prior to presenting them for the Commissioner of Oaths, with the exception of your signature. Affidavits must be signed in the presence of the Commissioner of Oaths.

Documents being signed must be written in English. If the person signing the affidavit does not speak English, interpreter services will be available through Language Line if required. It is at the sole discretion of the individual Commissioner of Oaths whether they choose to sign any document or declaration and they will not counsel or assist a person completing the affidavit document.

Fees

The fee for commissioning affidavits is $40 (including tax), for up to two signatures, and may be paid by debit, MasterCard, Visa or American Express.

The fee for commissioning a Proof of Life/Pension document for non-residents of Oakville is $15 (including tax), and may be paid by debit, MasterCard, Visa or American Express. There is no fee for Town of Oakville residents.

Notary

The Town Clerk’s office does not provide Notary Public services and cannot notarize or provide certified copies of documents. A list of notary publics or lawyers can be found in your local phone directory or online.
